By booking a fitting, purchasing a mouthguard, or using a Mana Waha Mouthguard product or service, you acknowledge and agree to the following Terms & Conditions.

Participation in sport and physical activity carries inherent risks, including accidental injury, concussion, dental damage, facial trauma, or bodily harm. Mana Waha Mouthguards are designed to help reduce the risk of dental and oral injuries during sport and physical activity. However, no mouthguard can guarantee prevention of concussion, dental trauma, facial injury, or other sporting injuries.

Injury & Concussion

Mana Waha Mouthguards are protective devices intended to assist in reducing impact forces to the mouth, jaw, and surrounding structures during sport and physical activity.

Research supported by the New Zealand Dental Association shows that properly fitted mouthguards help reduce the incidence and severity of dental and orofacial injuries. “They shield the teeth in an impact situation by providing a cushion which gives protection when the jaws are driven hard together. The New Zealand Dental Association recommends a good mouthguard should be of sufficient thickness in the correct areas, resilient, well retained, comfortable, and should not interfere with speaking and breathing.”

Evidence regarding concussion reduction continues to evolve,with studies suggesting mouthguards may contribute to reducing concussion risk and severity in some sporting environments, though they do not eliminate concussion risk entirely.

Mana Waha Mouthguards:

  • Help reduce the risk of dental and oral injuries

  • Help absorb and distribute some impact forces

  • May assist in reducing concussion risk in certain situations

  • Do NOT eliminate the risk of concussion

  • Do NOT guarantee prevention of injury

  • Do NOT replace safe sporting practices, coaching, medical care, helmets, or other protective equipment

By purchasing or using a Mana Waha Mouthguard, you acknowledge and accept these risks.

Acceptance of Terms

Different sports involve different levels of contact and impact. Mana Waha recommends varying mouthguard thicknesses and protection levels depending on the sport and level of physical contact involved.

Examples include:

  • Boxing, rugby, martial arts, and collision sports generally require thicker and higher-impact protection

  • Basketball and limited-contact sports may require lighter protection profiles

Our recommendations are guided by:

  • Clinical dental recommendations

  • Sport-specific risk considerations

  • Current sports dentistry guidance

  • Research and emerging dental studies from institutions including Yale University, our suppliers Henry Shein and Oraltech as well as other leading sports injury researchers

Mana Waha reserves the right to recommend specific mouthguard designs, thicknesses, or fitting approaches based on athlete safety considerations.


Limitation of Liability

Custom mouthguard fittings may involve:

  • Dental impressions

  • Pressure against gums, teeth, lips, cheeks, or tongue

Some discomfort may occur during the fitting process, particularly for individuals with:

  • Strong gag reflexes

  • Dental anxiety

  • Sensitivity during dental procedures

The fitting process should not be painful, though some temporary discomfort or gagging sensations may occur.

If you:

  • Have a strong gag reflex

  • Commonly gag during dental procedures

  • Have sensory sensitivities

  • Have medical conditions that may affect treatment

Please notify Mana Waha before your appointment so our team can prepare appropriately.

Mana Waha reserves the right to stop or postpone a fitting if client wellbeing or safety is at risk.

Eating Before Your Appointment

Athlete Responsibility

We recommend avoiding eating immediately before your fitting appointment.

Dental impressions can occasionally trigger gag reflexes, which may increase the risk of nausea or vomiting if food has been consumed shortly beforehand.

Clients attend fittings at their own discretion and accept responsibility for communicating any relevant medical or sensory concerns prior to their appointment.

To maintain hygiene, fit, and performance of your mouthguard;
After use:
- Rinse thoroughly in warm water
- Wash gently using warm water and mild soap
- Allow to air dry fully before storage
Important:
- Do NOT use boiling water
- Do NOT leave in hot vehicles or direct sunlight
- Do NOT chew on the mouthguard
- Do NOT store while wet in sealed containers

Heat exposure may distort the mouthguard and compromise protection and fit.

Mouthguards naturally wear over time and may lose effectiveness due to:

  • Heavy impacts

  • Chewing

  • Heat exposure

  • Growth and dental changes

  • General use

Replace your mouthguard if:

  • It becomes loose

  • It cracks or tears

  • It becomes uncomfortable

  • Significant impact damage occurs

  • Dental alignment changes

Children and adolescents may require more frequent replacements due to growth and tooth movement.

For a mouthguard to function effectively, it must:

  • Be worn correctly

  • Fit properly

  • Be appropriate for the sport being played

  • Be maintained and cared for appropriately

Mana Waha is not responsible for injuries resulting from:

  • Failure to wear the mouthguard

  • Improper use

  • Alterations or modifications

  • Poor maintenance

  • Use outside intended sporting activities

To the maximum extent permitted by New Zealand law, Mana Waha Mouthguards, its directors, employees, contractors, and representatives are not liable for:

  • Sporting injuries

  • Concussions

  • Dental trauma

  • Facial injuries

  • Medical complications

  • Losses arising from participation in sport or physical activity

Liability is limited to repair, replacement, or refund of the original product at Mana Waha’s discretion where required under applicable consumer law.

Nothing in these Terms excludes rights available under the Consumer Guarantees Act 1993.


For hygiene reasons:

  • Custom mouthguards are non-refundable once manufactured unless faulty

  • Clients must follow all cleaning and care instructions

  • Mouthguards should not be shared between individuals

Mana Waha reserves the right to refuse fittings where hygiene, safety, or behavioural concerns arise.
